The present Privacy Policy specifies how Weight Loss 360° (“Weight Loss 360°”, “we”, “us”, “our” and other similar expressions) collects, gathers, uses, stores, maintains and utilizes personal information provided on or through the Weight Loss 360° websites, www.weightloss360degrees.com and www.weight-loss-360.thinkific.com (collectively, the “Website” or the “Service”).

The present Privacy Policy further sets forth the rights attributed to users of the Website with respect to their personal information. In addition, the present Privacy Policy specifies how we protect personal information to allow you to make informed decisions when using the Website.

This Privacy Policy does not apply to third party services you may interact with or be directed to via the Website.

This Privacy Policy has been prepared based upon privacy and data protection laws applicable in Canada and United States. 

1. What information do we collect?

When you enroll as a student or subscriber (a “learner”) on the Website or related courses, as part of the enrolling process, we collect the personal information you voluntarily provide to us such as your name and email address.

2. How do we use your personal information?

Personal information refers to information relating to an identifiable individual. Such information may include but is not limited to your name, email address and telephone number. 

We use your personal information to enroll you into your chosen course and private online community. 

We may also use your contact information or any information provided to conduct surveys in order to enhance your experience on the Website. 

We may use your personal information to authenticate you as a user of the Website. We may also use your personal information in our provision of services to you, namely to provide courses, content, access to community guidelines and similar services.

We may send you emails about the Website and related course(s), registration, course content, your course progress, promotion of other courses offered by Weight Loss 360°, personalized answers to your questions, or other updates. We may also use your email to inform you about changes to course, survey you about your usage, or collect your opinion.

We may use your contact information to provide, manage and administer support requests. As such, we may use your contact information to respond to your questions, comments and requests.

We reserve the right to use your personal information to analyze and asses interest in the Website. We may use personal information and non-personal information to obtain analytical data regarding the Website, Website users and offerings. We may analyze usage patterns and data in the aggregate to better understand the efficiency of the Website. The analysis thereof is intended to help us improve offerings, enhance the user experience and improve overall efficiency.   

In accordance with applicable laws, we may use information collected from the Website in furtherance of public interest, or the public domain.

We respect your privacy.  Your personally identifiable information will not be shared, rented, or sold to any third parties for any reason.  Any information you share in private online coaching sessions will be held in strict confidentiality, unless required by law to release the same.  

You understand that any information you volunteer or share on or using the Website, including online community or group coaching sessions, will be accessible by other community members, Weight Loss 360° employees and management, and anyone enrolled in the program.     

3. How do you get my consent?

Upon providing us with personal information to become a learner on the Website; make a purchase; participate in a course, private online community, or group coaching sessions, you hereby consent to us collecting your personal information and using it for the reasons specified in this Privacy Policy only. Your provision of personal information on or through the Website constitutes your consent to us using your personal information as per this Privacy Policy.

If we request your personal information for a secondary reason such as marketing or testimonials, we will either ask you directly for your express consent, or provide you with an opportunity to refuse such usage.

How do I withdraw my consent?

5. Payment for Coaching Service

Weight Loss 360° offers coaching services as a stand alone service outside of the Thinkific platform.  These services are detailed at https://weightloss360degrees.com/coaching.  Payment for these services is made through our third party payment processor, Paypal.   Payments are encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction information is stored only as long as is necessary to complete your purchase transaction.  

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by the Website and related courses and its service providers.

6. Thinkific

Our courses and course sites are hosted by Thinkific Labs Inc. (“Thinkific”). They provide us with the online course creation platform that allow us to sell our products/services to you.

Your data is stored through Thinkific’s data storage, databases and the general Thinkific application. They store your data on a secure server behind a firewall.  

Payment

If you make a purchase on our site, we use a third party payment processor such as Stripe or Paypal. Payments are encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

7. Your Rights

Opt Out of Communications  

You may opt-out of receiving promotional communications and emails from us by selecting the unsubscribe link found within each promotional email. You acknowledge that you cannot opt out of receiving communications and emails relating to account notifications and transactional messages.

Modifying Your Information

You may view and modify information contained in your account by logging in to your account on the Website. You may proceed with the rectification or correction of information in your account. 

If you determine that your personal information is incomplete or requires a correction, you may request additions or supplements by contacting our support team.

Deleted Information

In order to be removed from the any of the Weight Loss 360° courses, you must make a specific request to be deleted.   You can send your deletion request by email to [email protected].  Upon our receipt of your request, we will proceed with the requested deletion, unless such information is required to be retained by law or for legitimate business purposes such as fraud prevention. Once your information is deleted, your account details such as name, email, and password will be permanently erased.

Following the completion or expiration of the course, whichever is sooner, the email address and personal details associated with such email will remain stored in our secure servers, unless we specify otherwise.  

8. Third Party Services

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. The third party providers will only collect and use information to the extent necessary to allow them to perform services in connection with our requests. Accordingly, we reserve the right to share information with authorized third-party providers to allow them to: (i) perform duties that we subcontracted to them, including processing payments, fulfilling transactions, verifying customer data and providing analytical data; and/or (ii) protect our Website against cyberattacks or other illicit online activity.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
